1. Introduction

These Terms of Service (“Terms”) apply to the use of the Wildflip Safaris website and to bookings made with Wildflip Safaris (“Wildflip,” “we,” “us,” or “our”).

They apply to safari tours, Kilimanjaro treks, Zanzibar holidays, cultural tours, accommodation, transfers, excursions, and other travel services arranged or operated by us.

By confirming a booking, making a required payment, or otherwise expressly accepting a quotation that incorporates these Terms, you confirm that you have read, understood, and accepted them.

Nothing in these Terms excludes or restricts a customer right that cannot lawfully be excluded under applicable law.

2. About Wildflip Safaris

Wildflip Safaris is a Tanzania-based tour operator located in Arusha, Tanzania.

Our services may include:

  • Private wildlife safaris;
  • Tailor-made itineraries;
  • Kilimanjaro trekking;
  • Zanzibar holidays;
  • Cultural experiences;
  • Accommodation;
  • Ground transportation;
  • Domestic travel arrangements;
  • Guided excursions; and
  • Related tourism services.

3. Travel Enquiries and Quotations

Submitting an enquiry does not create a confirmed booking.

Unless stated otherwise:

  • Initial safari enquiries and itinerary proposals are provided without booking obligation;
  • Quotations are based on the information supplied by the customer;
  • Availability is subject to confirmation;
  • Prices may change before a booking is confirmed if supplier rates, government fees, taxes, park fees, fuel costs, exchange rates, or other relevant costs change;
  • A quotation applies only to the itinerary, dates, number of travellers, accommodation level, and services identified in that quotation.

Any material change requested by the customer may require a revised quotation.

4. Booking Confirmation

A booking is considered confirmed when:

  1. Wildflip Safaris has issued or approved the relevant itinerary or booking proposal;
  2. The required deposit or full payment has been received; and
  3. Wildflip Safaris has acknowledged the booking in writing.

Availability of accommodation, flights, activities, guides, and other services cannot be guaranteed until the booking has been confirmed.

Customers are encouraged to book early, particularly for peak-season travel.

5. Person Making the Booking

The person making a booking on behalf of a group confirms that they are authorised to:

  • Make the booking;
  • Provide necessary traveller information;
  • Accept these Terms on behalf of travellers included in the booking where legally permitted; and
  • Communicate payment and booking requirements to the other travellers.

Each traveller remains responsible for complying with applicable travel, health, immigration, safety, and legal requirements.

6. Payment Terms

Unless different payment terms are expressly stated and agreed in your quotation:

  • A 50% deposit is required to confirm the booking.
  • The remaining 50% balance must be paid at least 30 days before the safari or tour start date.
  • For bookings made within 30 days of the tour start date, full payment is required at the time of confirmation.

A booking is not considered fully paid until cleared funds have been received.

Payment instructions will be provided by Wildflip Safaris.

Customers should only make payments through payment methods or accounts formally communicated by Wildflip Safaris.

7. Online Payments

Online payments may be processed through an independent payment gateway or financial-service provider.

Payment providers may apply their own:

  • Terms;
  • Security procedures;
  • Processing requirements;
  • Currency conversion rates; and
  • Transaction rules.

Wildflip Safaris is not responsible for an independent payment provider's systems except to the extent that liability cannot lawfully be excluded.

Customers should verify payment details before transferring money.

8. Pricing and Currency

Prices may be quoted in United States Dollars or another currency specified in the quotation.

Unless expressly stated otherwise, a quoted price applies only to the persons, dates, accommodation category, and itinerary described in the quotation.

The final quotation should identify the principal inclusions and exclusions.

Additional costs resulting from customer-requested changes may be charged separately.

9. Cancellations by the Customer

Cancellation requests must be submitted to Wildflip Safaris in writing.

The effective cancellation date is the date on which Wildflip Safaris receives the written cancellation.

Unless different conditions were clearly disclosed and accepted for a particular booking, the following cancellation fees apply:

  • 60 days or more before the tour start date: 15% of the total booking cost
  • 30–59 days before the tour start date: 30% of the total booking cost
  • 15–29 days before the tour start date: 50% of the total booking cost
  • 0–14 days before the tour start date: 100% of the total booking cost; no contractual refund

Where a refund is due, it will be processed in accordance with applicable law and the relevant payment arrangements.

Bank, currency-conversion, card, or payment-provider charges that are not retained by Wildflip Safaris may be subject to the relevant provider's rules.

These contractual cancellation charges do not remove any mandatory cancellation or refund right available to a customer under applicable law.

10. Failure to Travel or Unused Services

Except where applicable law requires otherwise, no refund will normally be due for services voluntarily not used after a trip has begun, including:

  • Accommodation;
  • Meals;
  • Park activities;
  • Transfers;
  • Excursions; or
  • Other prepaid services.

If a customer arrives late or leaves a tour early for reasons unrelated to Wildflip Safaris, unused services may be non-refundable.

11. Changes Requested by the Customer

Requests to change:

  • Travel dates;
  • Accommodation;
  • Route;
  • Activities;
  • Number of travellers;
  • Room arrangements;
  • Flights; or
  • Other confirmed services

must be made as early as possible.

Wildflip Safaris will make reasonable efforts to accommodate requested changes, but changes are subject to availability.

Additional supplier charges, price differences, or administrative costs arising from a customer-requested amendment may be payable by the customer.

12. Changes to an Itinerary by Wildflip Safaris

Safari and adventure travel takes place in environments where conditions can change.

Wildflip Safaris may reasonably alter an itinerary when necessary because of:

  • Weather;
  • Road conditions;
  • Wildlife movement;
  • Park restrictions;
  • Government requirements;
  • Safety concerns;
  • Accommodation changes;
  • Flight or transport disruption;
  • Natural events;
  • Operational requirements; or
  • Other circumstances outside reasonable control.

Where reasonably possible, we will seek to provide an appropriate alternative of a similar nature or standard.

Minor changes that do not materially affect the overall travel experience do not normally constitute cancellation of the booking.

13. Cancellation by Wildflip Safaris

In the rare event that Wildflip Safaris must cancel a confirmed trip before departure and the cancellation is not caused by the customer's breach, we will, subject to applicable law and circumstances:

  • Offer a suitable alternative of comparable value; or
  • Provide an applicable refund.

Different remedies may apply where performance is prevented by extraordinary circumstances outside our reasonable control.

14. Force Majeure and Events Beyond Our Control

Wildflip Safaris will not be responsible for failure, delay, or necessary changes caused by events outside our reasonable control to the extent permitted by law.

Such circumstances may include:

  • Severe weather;
  • Flooding;
  • Fire;
  • Natural disaster;
  • Epidemic or pandemic;
  • War;
  • Terrorism;
  • Civil unrest;
  • Government action;
  • Border closure;
  • Park closure;
  • Strikes;
  • Transport disruption;
  • Road closures;
  • Flight cancellations;
  • Changes in government regulations; or
  • Similar extraordinary events.

Where such an event occurs, we will make reasonable efforts to assist affected customers.

Additional expenses that are not part of the original booking may remain the responsibility of the traveller unless otherwise required by law or expressly agreed.

15. Third-Party Travel Suppliers

Some elements of an itinerary may be provided by independent third parties, including:

  • Hotels;
  • Lodges;
  • Camps;
  • Airlines;
  • Boat operators;
  • Balloon operators;
  • Activity providers;
  • Transfer providers;
  • Local guides;
  • Insurance providers; and
  • Other tourism suppliers.

These providers may be subject to their own operational and safety rules.

Wildflip Safaris will use reasonable care when selecting and coordinating suppliers but cannot control every act or omission of an independent third party.

Nothing in this section excludes liability that cannot legally be excluded.

16. Passports, Visas and Immigration Requirements

Travellers are responsible for ensuring that they hold:

  • A valid passport;
  • Any required visa;
  • Appropriate entry or transit permission;
  • Required certificates;
  • Any necessary permits; and
  • Other documents required for their journey.

Passport, visa, immigration, and entry requirements may vary according to nationality and may change.

Information supplied by Wildflip Safaris is intended as general travel guidance only.

Travellers should verify applicable requirements with appropriate government, embassy, immigration, or other official sources before departure.

Wildflip Safaris is not responsible for losses resulting from a traveller's failure to obtain required documentation except where liability cannot legally be excluded.

17. Health, Fitness and Medical Requirements

Safari travel and particularly mountain trekking may involve physical demands, remote locations, altitude, heat, uneven ground, extended drives, wildlife environments, and limited immediate access to medical facilities.

Travellers are responsible for assessing whether they are fit to participate in their selected activities.

Where relevant, travellers should seek advice from an appropriately qualified healthcare professional before travel.

Customers should inform Wildflip Safaris before departure of any condition, allergy, disability, mobility requirement, or other matter that may materially affect their safe participation or require reasonable travel arrangements.

Providing such information does not constitute medical advice from Wildflip Safaris.

18. Kilimanjaro and Adventure Activities

Kilimanjaro trekking and other adventure activities involve inherent risks.

These may include:

  • Altitude sickness;
  • Falls;
  • Fatigue;
  • Dehydration;
  • Weather exposure;
  • Temperature extremes;
  • Difficult terrain; and
  • Limited access to emergency medical care.

Summit success can never be guaranteed.

Travellers must follow reasonable safety instructions given by guides and authorised personnel.

Wildflip Safaris may require a participant to modify or discontinue an activity where continuing would present a material safety risk.

19. Travel Insurance

All travellers are strongly encouraged to obtain comprehensive travel insurance appropriate for their itinerary.

Depending on the trip, suitable cover should be considered for:

  • Medical treatment;
  • Emergency evacuation;
  • Repatriation;
  • Trip cancellation;
  • Trip interruption;
  • Delayed or cancelled flights;
  • Lost or damaged luggage;
  • Adventure activities;
  • High-altitude trekking; and
  • Personal liability.

Customers are responsible for checking the terms, limits, and exclusions of their chosen insurance.

Wildflip Safaris does not act as the customer's insurance adviser merely by providing general information about insurance.

Zanzibar

Travellers whose itinerary includes Zanzibar must comply with the mandatory inbound travel-insurance and other entry requirements imposed by the relevant Zanzibar authorities at the time of travel.

These requirements may be separate from any personal travel-insurance policy already held by the traveller.

20. Wildlife and Natural Environments

Wild animals move freely in their natural environments.

Wildflip Safaris therefore cannot guarantee sightings of:

  • Particular species;
  • The Big Five;
  • Predator activity;
  • River crossings;
  • Migration herds; or
  • Any particular wildlife event.

Migration patterns, animal behaviour, vegetation, water availability, and sightings are influenced by natural conditions.

Guides will use their local knowledge and experience to provide the best reasonable opportunities for wildlife viewing, but nature cannot be controlled.

21. Park and Conservation Rules

Travellers must comply with:

  • National park rules;
  • Conservation-area rules;
  • Wildlife regulations;
  • Instructions of rangers;
  • Instructions of Wildflip Safaris guides; and
  • Safety procedures.

Guests must not intentionally disturb, feed, approach, or interfere with wildlife except where expressly permitted and safely managed.

22. Customer Conduct

Customers must behave in a manner that does not:

  • Endanger themselves or others;
  • Threaten staff, guides, communities, or other guests;
  • Damage property;
  • Harass other persons;
  • Interfere with wildlife;
  • Seriously disrupt the tour; or
  • Violate applicable law.

Wildflip Safaris may remove or refuse further participation to a traveller whose behaviour presents a serious safety, legal, or operational risk.

Where removal results from the traveller's misconduct, additional expenses will normally be the traveller's responsibility, subject to applicable law.

23. Cultural Experiences

Travellers participating in cultural or community visits are expected to act respectfully.

Customers should:

  • Follow guidance from local hosts and guides;
  • Ask permission before photographing individuals;
  • Respect local customs;
  • Avoid exploitative conduct; and
  • Respect community rules and private property.

24. Accommodation

Hotels, lodges, camps, and other accommodation may occasionally need to be changed because of availability, operational circumstances, or conditions outside our control.

Where reasonably possible, Wildflip Safaris will arrange an alternative of a similar standard.

Accommodation descriptions and classifications may differ from rating systems used in a traveller's home country.

25. Transport and Roads

Travel within Tanzania may involve:

  • Unpaved roads;
  • Long driving distances;
  • Variable road conditions;
  • Seasonal weather;
  • Traffic;
  • Wildlife-related delays;
  • Domestic flights; and
  • Remote areas.

Journey times provided on the website or in an itinerary are estimates and are not guarantees.

26. Flights and Transport Delays

Independent airlines and transport operators control their own schedules.

Wildflip Safaris cannot guarantee:

  • Departure times;
  • Arrival times;
  • Seat assignments;
  • Baggage handling; or
  • Absence of delays or cancellations.

Customers should allow reasonable connection time and maintain suitable travel insurance.

27. Baggage and Personal Property

Travellers remain responsible for their own:

  • Passports;
  • Money;
  • Cameras;
  • Phones;
  • Jewellery;
  • Luggage; and
  • Other personal property.

Wildflip Safaris recommends keeping valuables secure and following baggage restrictions communicated for safari vehicles and light aircraft.

28. Photography and Video

Photographs and videos may be taken during a tour.

If Wildflip Safaris wishes to use an identifiable traveller's image for promotional purposes, applicable privacy requirements and communicated customer preferences will be respected.

Travellers who do not wish to appear in promotional material should notify us.

29. Website Content

Website content is provided for general information and travel-planning purposes.

Although we make reasonable efforts to keep information accurate and current, matters including:

  • Prices;
  • Park fees;
  • Visa requirements;
  • Health requirements;
  • Accommodation availability;
  • Flight schedules;
  • Wildlife patterns;
  • Government requirements; and
  • Travel restrictions

may change without notice.

Your confirmed quotation and final itinerary should be used to determine the specific services included in your booking.

30. Intellectual Property

Unless otherwise stated, website text, branding, graphics, photographs, videos, itineraries, designs, and other original materials owned by Wildflip Safaris are protected by applicable intellectual-property laws.

They may not be reproduced, commercially distributed, republished, or misused without appropriate permission.

31. Acceptable Website Use

Users must not:

  • Attempt unauthorised access to the website;
  • Introduce malware or malicious code;
  • Interfere with website security;
  • Use the site for fraudulent activity;
  • Impersonate another person;
  • Submit intentionally false booking information; or
  • Use website content unlawfully.

32. Privacy

Personal information collected in connection with enquiries, website use, and bookings will be handled in accordance with our Privacy Policy and applicable law.

33. Limitation of Liability

To the maximum extent permitted by applicable law, Wildflip Safaris is not responsible for losses resulting solely from circumstances outside its reasonable control or from a traveller's own acts, omissions, failure to follow
